1. Purpose
This Acceptable Usage Policy ("Policy") defines the terms governing the use of Kaluari Cloud Backup services.
The purpose of this Policy is to ensure:
- Reliable and secure backup and recovery services
- Fair and efficient use of resources
- Consistent service performance and availability
- Clear responsibilities between Kaluari and the Client
2. Scope
This Policy applies to all Kaluari Cloud Backup services, including:
- Cloud backup services
- Backup and replication services
- Disaster Recovery as a Service (DRaaS)
- File, virtual machine, application, and SaaS data protection
3. Acceptable Use
3.1. Permitted Use
Kaluari Cloud Backup services are intended solely for:
- Data backup and recovery
- Disaster recovery and business continuity
- Business-related data protection and archival
3.2. Prohibited Use
The following activities are strictly prohibited:
- Use of backup storage as primary or production storage
- Storage of non-backup data unrelated to recovery purposes
- Storage or transmission of illegal, harmful, or unauthorized content
- Attempting to disrupt, overload, or misuse the service infrastructure
- Circumventing usage tracking, licensing, or service controls
Kaluari reserves the right to suspend or terminate services for violations of this Policy.
4. Fair Usage Policy
4.1. General Principle
Kaluari Cloud Backup operates on a fair usage model to ensure equitable access and consistent performance across all the Client.
4.2. Data Allocation
The Client is allocated storage and service capacity based on their subscription tier and the type of protected workload.
Allocation models may include one or more of the following:

Workload-Based Allocation – Measured per protected resource, such as virtual machines, servers, or applications

User-Based Allocation – Measured per user for SaaS or end-user data protection

Capacity-Based Allocation – Measured by total storage consumption (GB/TB), typically for file systems and unstructured data

Replication & Disaster Recovery Allocation – Measured based on:
- Size of replicated workloads
- Recovery-site storage consumption
- Infrastructure resources reserved for failover
The Client may have a hybrid allocation model depending on subscribed services.
4.3. Excessive Usage
Usage is considered excessive where consumption exceeds reasonable and expected patterns for the subscribed service.
Kaluari Cloud Backup reserves the right to determine excessive usage based on factors including:
- Type of workload
- Data growth trends
- Storage consumption
- Backup and retention configuration patterns
Where excessive usage is identified, Kaluari reserves the right to:
- Apply additional charges
- Require subscription or capacity adjustments
- Implement usage controls where necessary
Kaluari will make reasonable efforts to notify the Client prior to taking corrective action.
5. Backup Configuration & Responsibilities
5.1. Backup Policy Design
The Client is responsible for defining backup configurations appropriate to their environment.
Kaluari recommends:
- Segregating workloads by type and criticality
- Avoiding overly large or complex backup policies
- Aligning backup configurations with business recovery objectives
5.2. Retention Policy
Retention periods are defined and managed by the Client based on business, operational, and compliance requirements.
Kaluari Cloud Backup does not enforce minimum or default retention periods unless explicitly agreed in writing.
The Client is responsible for:
- Defining appropriate retention settings
- Ensuring compliance with regulatory requirements
- Managing storage consumption resulting from retention choices
Storage consumption is directly influenced by retention configuration and may impact billing where applicable.
6. Replication & Disaster Recovery
6.1. Intended Use
Replication and disaster recovery services are intended for:
- Business continuity
- Disaster recovery scenarios
- Periodic testing of failover readiness
6.2. Usage Restrictions
The Client may not:
- Use disaster recovery environments as permanent production systems
- Run continuous production workloads on recovery infrastructure unless explicitly agreed
7. Security & Client Responsibilities
The Client is responsible for:
- Securing access credentials and authentication mechanisms
- Restricting access to authorized personnel only
- Ensuring data being backed up is free from malware or harmful content
- Maintaining source system health and accessibility
- Ensuring compliance with applicable laws and regulations
8. Network & Connectivity
The Client must ensure:
- Adequate and stable network connectivity
- Required ports and access configurations are maintained
Failure to meet these requirements may result in backup or replication failures.
9. Monitoring & Notifications
Kaluari Cloud Backup will:
- Monitor backup operations and system health
- Generate alerts for failures or risks
- Notify the Client of significant issues where applicable
The Client is responsible for reviewing alerts and taking appropriate action.
10. Data Integrity & Testing
The Client is responsible for:
- Periodically testing data restoration
- Verifying backup integrity
- Ensuring recovery objectives (RPO/RTO) are met
11. Service Enforcement
Failure to comply with this Policy may result in:
- Additional charges
- Service limitations or throttling
- Suspension or termination of services
12. Termination & Data Retrieval
Upon service termination:
- The Client will be provided a limited period to retrieve their data
- Data not retrieved within this period may be permanently deleted
- Data retrieval or export services may incur additional charges
13. Best Practice Recommendations
The Client is advised to:
- Maintain multiple copies of critical data
- Use a combination of local and cloud-based backups
- Encrypt sensitive data
- Regularly review backup reports and configurations
- Test recovery processes periodically
14. Policy Updates
Kaluari reserves the right to update this Policy as required to reflect:
- Service improvements
- Regulatory requirements
- Operational changes
Kaluari may modify these Terms at any time in its sole discretion, by posting a revised version on our website.
